“4 Secrets of Getting the Best Possible Defense”

SECRET #1: Do not answer any questions until you speak with your lawyer. You’ve heard on television the common Miranda warning, which begins, “You have the right to remain silent.” So take that to heart and don’t answer any questions. Instead, tell the policeman or prosecuting attorney that you want to speak with your lawyer. Then, regardless of what the policeman says -- regardless of what the prosecutor says -- don’t say anything until you speak with your lawyer. If you answer questions without first talking with your lawyer, you can be sure of one thing: “Anything you say can and will be used against you in a court of law.” Don’t answer any questions until you speak with your lawyer.

SECRET #2: Do not provide samples for testing until you speak with your lawyer. In this case, follow the same advice I gave about answering questions: Do not provide any samples -- for any reason -- until you speak with your attorney.

SECRET #3: Request hearings in a timely matter. Often a criminal case will initiate procedures with the Texas Department of Public Safety regarding your ability to keep your driver’s license. It is important to request hearings in a timely matter to protect your right to contest certain actions by the Texas Department of Public Safety, such as the suspension of your driver’s license.

SECRET #4: Hire an experienced attorney. When you go into criminal court, you have a lot at stake. Criminal court is not child’s play. You could lose your driver’s license. The judge could order you to pay a large fine. You could end up in jail. And more. Don’t risk letting these things happen to you. Make sure you hire an experienced lawyer. Because if you don’t, you will wish you had.
